SB 128 - Danny Osborne
SB 128, the supplemental year bill. This bill, which would allow local school boards to let students use next year as an supplemental year, has passed the Senate and the House Education Committee. It will likely pass the House. There has been a flood of misinformation about this bill so please read the bill. Under the proposal, all students K-12 could request to use next year as a supplemental year, even if they graduated this year. Requests would have to be submitted to local boards by May 1 and boards must decide by June 1 whether to accept all or none of the requests. If a board does not approve all of the requests, no students in that district would have a supplemental year. If a board approves the requests, it shall develop a “plan for implementing the supplemental school year and the temporary program for graduated seniors and may adopt policies on grades, schedules, classifications, graduation ceremonies, and other operational issues in offering the supplemental school year.” The bill also allows a student to have a fifth year of athletic eligibility during high school, but would not change the age rule, which says that any student who turns 19 before Aug. 1 in a given year is no longer eligible.
This supplemental school year program would not affect a District's ability to fail or retain a student. So if the Board decides not to adopt the program and allow the supplemental school year, the District could still fail or retain a student. One issue, however, is that KHSAA may treat students in those two scenarios differently. HB 128 allows 5 years of eligibility to students who utilize the supplemental school year.
